The 11th U.S. Circuit Court of Appeals’ ruling turned on a now-obsolete term known as the „penis exemption,” which said that a government employee’s genitalia could not be considered a „dangerous weapon” and thus not subject to assault charges under Georgia’s criminal code.
The case began in 2008, when Darryl Hunt was arrested after he entered a men’s room at the Indian Wells Tennis Garden in California. He was charged with misdemeanor assault, but the law seemed to contradict the rationale for the criminal charge.
„The penis has historically been held in the highest esteem, and for good reason. It’s the only part of the body that can become pregnant. It has been used as currency for at least 13 centuries,” the three-judge panel wrote in the ruling, citing the published medical dictionary „Sydney’s Medical Dictionary,” which said the word „penis” comes from the Latin „penna,” which means „little feather.”
To this day, the court ruled, the term „penis” still means „the small, erect organ of one man which another has put inside another’s vagina.”
The panel said the law itself indicated that the exemption was a gross mistake. It noted that the Georgia legislature enacted the law after the U.S. Supreme Court struck down parts of a law in Virginia that made it a crime to expose one’s genitals to a person of the same sex. And it called the Georgia legislation „blatant homophobia.”
„We find it highly improbable that the Georgia legislature, in 1824, intended to criminalize a penis-in-vagina assault, but not a penis-in-anus assault or a penis-in-mouth assault,” the court said. „And if a man put his penis in another man’s mouth and then caused bodily harm, that person would not be prosecuted under the Georgia assault statute.”
The court also pointed to the handwritten notes made by the Georgia lawyer who was behind the law. He wrote that the legislation was „just a small part of a bill which abrogates the laws of sodomy and would punish
